My van is a write off...........apparently!

Imagine my absolute horror this afternoon when I opened an letter from dvla saying they have been informed by "an insurance company" that my van has been written off in an accident and should be disposed of! My insurance company know nothing about this.....it's also taxed.....though I didn't get a reminder, which was odd! Anyhow, DVLA told me I can appeal the decision........appeal what!!! Technically, my van shouldn't be on the road......obviously. What an absolute nightmare! Anyone got any words of wisdom? I could,t eat my dinner tonight.....I'm so outraged at this bollox!!
 
Call and email DVLA. It would be a good idea to pop in to your local police station and let them know. They may not be able to do much but you’ll have registered the issue if there is a problem further down the road, as I suspect ANPR will be pinging every time you pass a cop car with a reader. (Or, move to Cornwall….DAMHIK!)

Have you got legal cover on your insurance policy?

Might be a good idea to get the legal team on this.

Must be a case of stolen identity (of the van)

What a nightmare. I can only think that if you have any insurance, AA or RAC policies with legal protection cover then it would make sense to discuss it with one of them. Good luck.
 
Thanks gents. No, I've never had a claim.......this has come out of the blue. I've had the van from new since 2016!!! DVLA wouldn't tell me anything.....I have to ring a case worker tomorrow. Funnily enough, I was pinged by a DVLA ANPR car a couple of weeks ago. I hadn't taxed the van.......but I hadn't received a renewal from DVLA. I know it's my fault the van wasn't taxed but that was a genuine mistake down to not getting a reminder. The DVLA guy was actually really good and could see it was genuine. His scanner picked me up when we were at opposite ends of the road. Fortunately, I'd pulled into my customer's drive!! He said good job I was on a private drive or he'd have had no option but to clamp me. I got my wife to tax it straight away! It's the bit about an insurance company writing it off that has me worried. So now, I either risk using the van or lose my customers and my income until this is sorted........talk about rock and a hard place!
 
Sounds like the ANPR tax thing adds to your stress but is a red herring and isnt an issue, confirmed by DVLA.

Yes but its not YOUR insurance company, so I would check with them after speaking to DVLA. If they say its ok, then you have an MOT'd, taxed, Insured vehicle with no physical damage so fine to drive around whilst this is resolved. Sounds like a scam or registration keying error. Google "told my car is a write off by insurance company scam". Pain in A to sort out though :(

The DVLA letter said it is not to be driven on the public road and taken to a disposal centre!! After holding for 45 minutes, the girl I spoke to this afternoon very helpfully said "You can appeal"! I said "appeal what"?? Aviva have no record of an accident. I just know this is going to be stressful. If I get stopped by the Police, technically, I believe they can seize it and probably crush it!! I've never had anything like this to deal with before so I'm not dealing with it very well.......I'm f*cking furious!! I just hope my "case worker" at DVLA has some sense tomorrow!! I think I should print off my road tax acknowledgement and my insurance details and keep them with me........if I dare venture out!! And all those w*nkers driving about with no licence/insurance/road tax.......I'm boiling!!
 
Yeah my stress levels would go through the roof as it seems you are powerless. What a nightmare!

Did Aviva tell you you are not insured now? What did they advise you should do? If they have no record and you can argue that because of this you are still insured then you are still legally insured, taxed & MOT'd (these are the key things) so can carry on driving whilst this is sorted out. Keep these docs in yur van along with a V5 copy and if in the very unlikely situation you get stopped you can show proof of ownership, tax, MOT, insurance . Explain you have been scammed, and I very much doubt any Police will want to bother further.

Do the appeal. Make sure you follow the process correctly and check with DVLA if unsure. I have found when you do eventually talk to a human they are very helpful

Hi.

Looking objectively at the trail above. I’d imagine DVLA get information from the Insurance Underwriters. (CUE - Claims Underwriters Exchange and MIB -Motor Insurers Bureau.) If you speak to your insurance company and explain (as you’ve owned the van since new you know the history) the situation, they (insurance company) will have access to this Data Base. If????? there has been an entry against your van registration, they should be able to advise what date and I’m sure basic details, for example when the date of the alleged accident happened etc. etc. This would be a start. If said van is involved in said incident resulting in ‘beyond economical repair’, this would be documented somewhere with a report of damage. (Insurance companies HATE paying out so need evidence), so nowadays there will be an electronic and or paper trail to verify the write off of the van.
If your insurance company can only supply ‘basic’ details over the phone, a Formal Request for Information to the CUE or MIB (you can call or do this online) should supply you with everything they hold on you and your van. Edit to say @Howzat has helpfully posted link above in his post. (Sorry @Howzat didn’t see your post as I was typing)
If when speaking to insurance company they say they can see no evidence of write off on the data base and you are still insured, I’d get an email to this effect, including some blurb about the DVLA’s alleged perception, and keep this in the van incase you get stopped (but unlikely) Then, as far as you are concerned you still have insurance, and your MOT shows it’s roadworthy. (As others state above keep copies of all this in the van).
If you’d just bought the van I’d be thinking the worst, but as you irrefutably know the vans providence, as owned from new, you understand there is some ‘cock up’ somewhere. You, along with your insurance company and DVLA just have to find it. (Not a throw away statement I promise 🤗 as I can imagine how stressful this must be). To put this in perspective even a windscreen repair goes on some sort of claims data base. I can recall a few years ago getting called up by ‘Personal Injury Specialists’ literally every week over a period of a couple of months, asking about my ‘accident’ and was I injured, we can help blah blah. All because I made three separate claims for some windscreen chips.
I really wish you the best and the above would be my objective strategy. Keep using the van until your insurer says otherwise and keep us posted.

Also further edit whilst I had a think…..on the DVLA website you can check your vans MOT history. I know you know it as you’re the owner but depending when DVLA allege it was written off, their own database of MoT may contradict this. Also if you know date of alleged accident, you may be able to offer irrefutable evidence to state you were elsewhere or it had an MOT a day later so how could it possibly have been written off. (That kind of thing). -just a thought 👍

Call insurance company - ask for legal assistance.

I always take the legal cover option when insuring the van.... A cheap add on that can be very powerful when you need it.
 
Massive sympathies for your situation what a bloody nightmare!

I dunno what I'd do in this situation. It's reeeeeally confusing to me that the DVLA are telling you the car is a right off and shouldn't be driven.

Am I being thick? Surely if a car is written off it's an insurance term and not a physical state assessment. If a car is insured (as yours is), has an MOT and tax (as yours has) then it isn't on the road illegally. My Mrs' car (old ford focus) had the front end ripped off in an RTA (bumper and wing). It was written off and I decided to keep it and repair it myself - this is perfectly legit. The DVLA didn't send me any demands it be kept off road.

This whole situation stinks to high heaven.

Have you called the police for advice and potentially a crime number? If the DVLA haven't immediately raised an investigation into this then surepy they are complicit? Havr you called the DVLA number from the website or the number from the letter and are the numbers different?

I got done years ago for a speeding offence which was a mistaken identity of vehicle over 1 letter my car had a G in reg the offending car had a C so it could be as simple as that sort of thing or a fat fingered keyboard operator
OR has the DVLA been HACKED
