Motor caravan or not?

Good morning. I’m new to this, so please bear with me for asking stupid questions.
I came for my 1st night away & needed to be near Exmouth anyway. The parking in 1 place says ‘no motor caravans 8pm - 8am’. I looked up the dvla definition of a motor caravan & one of the stipulations was ‘high roof’ and that a pop-top definitely didn’t count. Does that mean that I can park here overnight (obvs paid for) since I’m not in a motor caravan? I’m confused & don’t want to annoy anybody or get a fine. On the upside, the kettle is on & the sun is shining.IMG_8001.webp
 
It’s a bit of a grey area. The council will properly say no sleeping in vehicles overnight.

The dvla won't accept that it's a motor caravan.

But as Mikey says it's probably the council that run the carpark, and they will have different ideas.

Couple of options.

Move to somewhere else,

Drop the roof and stealth camp,

Dig you're heals in and stay.

Id just move somewhere else, there is bound to be a nice britstop somewhere near by.... Nothing better than a Pie&Pint free free parking.
 
Overnighting is allowed on Queens Drive car park Exmouth, I think the no motorhomes is on the beach side of the road. We use the Maer car park because it’s a bit quieter at night.

The DVLA guidance is just what they require to change the V5.

You meet the legal definition of a Motor Caravan, and if you are ever pinged by a no ANPR speed camera and given a speeding ticket because they think you are a panel van, you will be relying on the fact that you are a Motor Caravan.

Exactly this.

Neither the DVLA or the local authority where you are parked get to decide what's a motor caravan. Only legislation, via Con and Use regs, does that. I keep a copy of the pertinent sections in my glovebox.

Legislation alone, in this case con and use, determines what type of vehicle constitutes a Motor caravan. Taxation class, body type, etc, are administrative divisions used by the DVLA and have no bearing on the vehicles legal  type.
