My van is a write off...........apparently!

Time for a private plate ?
Would that refresh the paperwork trail ?
Whilst you’d have no problems acquiring a cherished registration, when you asked the DVLA to assign it to the vehicle they’d check their database then reject your request as they’d see a note to the effect that the vehicle had been scrapped.
 
Just a thought gents. I really want to pursue the f*ckwit that did this. I also want to claim for at the very least, a days lost pay. So, I have to find out which insurance company did this. Not sure how to go about this. M
Also, maybe contact the insurance ombudsman? I did wonder about using my motor insurance legal cover......but then that'll be classed as a claim.......and we know what will happen then!!!
Anyone got any ideas because they shouldn't get away with this!!

Try and find a specialist solicitor who in the first instance can advise you. Then depending on what he might advice, press on or not.
 
SAR to the DVLA will likely reveal their identity.

Once thers established make contact. They'll brush you off, then go down the small claims route.
 
I've just found the number for the ombudsman......I'll call them tomorrow and see what they say........which probably won't be a great deal!!
Unfortunately, you won't get to speak to the ombudsman - there's a tortuous and prolonged process to follow before you get anywhere near the ombudsman. I raised my case with the Motor Ombudsman Service over 2 years ago and that's still ongoing.

Regulators these days, in any field, just don’t have the resources or powers they need. They’ve been degraded over the last 15 years.
 
@mopardave personally I think the whole thing is going to be a nightmare.
The hardest thing is going to get your van off of being a write off, they now have it that your VIN and or REG is pertaining to a write off, your never going to a picture of the whole van and vin all in one shot.
I would ask the DVLA who they would use if they needed to prove wrong doing of a vehicle then use them do the reverse proving your vehicle and vin are not a write off.
i wouldn't worry or pursue who f***ed up so you can claim a days dosh worry more about getting it back on the DVLA's database as road legal
I bet if you tried to insure it the van does not exist so no insurance company will want to know. dont know how the police would view it if your stopped.
My van was first registered wrong I had all the correct paperwork from dealer DVLA would not change it until VW confirmed correct details thats how i know its a nightmare.
I do feel very sorry for you, but people out there to help you in places like the DVLA are few and far between nowadays.
 
It shouldn't be too hard. As a copper on autocrime I'm once went to a very similar job, had to closely eyeball a car on behalf of the DVLA and check it wasn't written off and no one was pulling a fast one. Why the DVLA couldn't do thet themselves is anyone's guess.

Anyway, once that's done the DVLA correct their records.

With the paperwork from the DVLA he can then approach the insurer concerned and get them to correct their error (if the DVLA themselves haven't already done so.) Remind them that it is an offence under DPA to keep information on record thst they know to be incorrect and they will sort it on pain of significant fine from the ICO.

He will get there. It may be a little protracted, but there is a clear path to remedying this cock up and ensuring the vehicle is not incorrectly recorded anywhere as having been written off.
 
They'll never tell you ordinarily, but once this is done submit a subject access request and there's a very good chance the papers will reveal their identity, and also provide you with the proof you need to anally invaded them for some compo for their incompetence.
Think the Subject Access Request (SAR) is a good route, as you reg is linked to you it forms part of the personal data, also in the SAR say you also want to know who requested the change to be a write-off.

GDPR also gives you rights to have the data corrected.

My previous 68 plate van's registration started with WO, but somebody at DVLA decided it was W0.
I only found out about it when the French Police stopped me just outside Lille and impounded the van as it showed not insured on their database. Took me a couple of days of frantic phone calls to VWUK, DVLA and my insurance company before it was released.
No apologies or communication from DVLA other than an new V5.

From what I've read on here, not necessarily a van! Nobody seems capable of joining the dots these days!!
I think this is quite common and only going to get loads worse.
I don’t want to be agist but a massive proportion of the kids/young adults today struggle to think, let alone apply real critical thinking in complex situations.
Way too much is done for them with apps and other forms of support IMHO.

Or they just don’t feel they get paid enough and therefore have zero interest. Possibly.

These departmental mistakes are now being touted as one of the reasons the Government wants open access to view everybody’s bank account - so they can check the DWP hasn’t overpaid anyone. Why that means they need access to view those that aren’t claiming anything is beyond me.
